People all over the nation have been waiting with baited breath to hear a decision on the appeal of Purvi Patel’s case. The successful prosecution of Purvi Patel established a dangerous precedent for punishing the pregnancy outcomes of people of color in Indiana and in other states with similar laws.
A problem with the 'lung float test', other than false positives, is the possibility that a premature, miscarried 'baby' might very well try to breathe but be unable to absorb enough air to survive. Thus, the 'baby' might very well look dead, especially to a woman who has just undergone the trauma of delivering prematurely/miscarrying. Nor is it likely that any later medical intervention could have brought this 'baby' back to life.
Which is to say that it's difficult to understand how what is a faulty test could do anything other than possibly show that the 'baby' had attempted to breath but couldn't draw sufficient breath to appear to be alive.
