Not Only Is Trump’s Refugee Policy Morally Wrong, it Is Illegal in US and Int’l Law

The Family Separation Policy that Trump has “temporarily” set aside (in favor of indefinite detention of entire families) has in some ways obscured what is really going on in Trump’s refugee policy overall. In essence, the Trump administration is attempting gradually to abolish the acceptance by the US of asylees, in stark contravention to US treaty obligations (and hence to domestic US law).

These measures are being taken at a time when the world refugee crisis is more acute, with 68 million displaced, than at any time since World War II.

As usual Professor Cole delivers. We are witnessing the systematic dismantling of the rule of law in Amerika. The trump regime is example in all its aspects and advisers, cabinet heads, domestic and foreign policy, of the worst in society and government - the kind of tyranny we supposedly rejected many times and fought against, but the hydra only turned into our own tyrants, systematic vulture capitalism, and corrupt subversions of government - the ugly metamorphosis is nearly complete and the grotesque result should be reviled and fought with great vigor by all with any conscience, empathy, moral compass, integrity, and humanity…

Immigration law for the most part falls under civil administrative law and has fewer due process protections. Fewer than 38% even have a lawyer. Under criminal justice laws that can apply, all due process protections apply. In any case, there needs to be independent monitoring.
