State Supreme Court Allows Lawsuit Against Gun Maker to Move Forward in 'Massive Victory' For Sandy Hook Families

Julia Conley, staff writer

The maker of the semi-automatic assault rifle that was used in the Sandy Hook massacre in 2012 can potentially be held liable for the 26 killings the gun was used to commit, the Connecticut Supreme Court ruled Thursday.

From the article:

“The families’ lawsuit can now bypass the Protection of Lawful Commerce in Arms Act, which Congress passed in 2005, making it impossible for survivors of gun violence to hold manufacturers accountable for selling weapons to shooters.”

Somebody please correct me if I’m wrong, but wasn’t the shooter’s MOTHER the purchaser? How does Remington bear more liability than she does (except, obviously, for having deeper pockets)? This woud seem to be another example of hard cases making bad law, and leaving unaddressed the question as to what turns a person into a homicidal maniac.

No matter how you market firearms they will get into the hands of those who want them. We may discourage a few from acquiring a weapon. But they will be gotten by criminals easily, and by otherwise law abiding citizens that want something for home and family protection. Like one of those Saturday night specials, or a semi-automatic.
